1. Acceptance of Terms

Agreement to Terms

By accessing or using Resume Boost (including the web application at https://resumebs.com and the Chrome extension), you agree to be bound by:

• These Terms of Service ("Terms")
• Our Privacy Policy (incorporated by reference)
• Chrome Web Store Developer Program Policies (for extension users)

If you do not agree to these Terms, do not use Resume Boost.

Updates to Terms

We may update these Terms from time to time. Changes will be effective:

• Material Changes: 30 days after email notification to all users
• Non-Material Changes: Immediately upon posting updated "Last Modified" date

Continued use of Resume Boost after changes = acceptance of new Terms.

Your Options:

• Delete your account before effective date if you disagree

2. Service Description

What Resume Boost Provides

⚠️ Important: What Resume Boost Is NOT

We Are a Coaching Tool, NOT:

• ✗ A job placement service or employment agency
• ✗ A guarantee of job interviews, offers, or employment
• ✗ Professional career counseling (we're AI-powered, not human counselors)
• ✗ A tool for employers to screen candidates (see NYC Local Law 144 disclaimer)
• ✗ Legal, financial, or professional advice
• ✗ A replacement for professional resume writers

Resume Boost is for job seekers, NOT employers.

3. Eligibility

Age Requirement

You must be 18 years or older to use Resume Boost.

• We do NOT knowingly serve users under 18
• We do NOT knowingly collect data from children under 13 (COPPA)
• If you are under 18, DO NOT create an account

Parental Notice: If your child under 13 has created an account, contact us immediately for deletion: support@resumebs.com

Prohibited Users

You may NOT use Resume Boost if:

• You are under 18 years old
• You have been previously banned or suspended
• You are a competitor conducting unauthorized research or scraping
• You are using Resume Boost to violate laws or third-party rights

4. Account Registration & Security

Account Creation

To use Resume Boost, you must create an account:

Account Security - Your Responsibilities

You are responsible for:

• Maintaining the confidentiality of your password and account credentials
• All activity that occurs under your account (even unauthorized use)
• Notifying us immediately of any unauthorized access: support@resumebs.com

We Recommend:

• Use a unique password (not used on other sites)
• Enable two-factor authentication if available (Google/Apple OAuth)
• Do NOT share your account credentials with anyone
• Log out after each session on shared devices

5. Acceptable Use Policy

Permitted Use

You may use Resume Boost to:

• Analyze and optimize your own resume
• Track your own job applications
• Generate cover letters and interview prep for yourself
• Import job postings you're interested in (via Chrome extension)
• Receive AI-powered career coaching

Prohibited Activities

Consequences of Violations: Account suspension, termination, legal action, referral to law enforcement (for illegal activity).

6. Intellectual Property Rights

Resume Boost Owns

• AI Prompts & Algorithms: Proprietary prompts, scoring algorithms, matching logic
• Software & Code: Web application, Chrome extension, backend services
• Branding: "Resume Boost" trademark, logos, design assets
• Documentation: User guides, help content, API documentation

You Own Your Content

You retain all rights to content you create or upload (resume, cover letters, notes, etc.). By using Resume Boost, you grant us a limited license to:

• Process your content through AI services (Anthropic, OpenAI, Google, Perplexity)
• Store your content on our servers (Supabase database)
• Display your content back to you in the application
• Use de-identified, aggregated data to improve our services

We Do NOT:

• ✗ Claim ownership of your resume or content
• ✗ Share your identifiable content with employers without your consent
• ✗ Use your content for advertising or marketing

AI-Generated Content

Content generated by AI (resume suggestions, cover letters, etc.) is provided "as-is" for your use. You are responsible for reviewing, editing, and ensuring accuracy before submission to employers.

7. AI Services Disclaimer

No Guarantee of Results

Resume Boost Does NOT Guarantee:

• Job interviews, offers, or employment
• Improved ATS pass rates or employer responses
• Accuracy of AI-generated content
• Compatibility with all ATS systems or job boards
• Freedom from AI bias or hallucinations

Your Responsibilities:

• ✓ Review and edit all AI-generated content before use
• ✓ Verify facts, dates, and claims in your resume
• ✓ Do NOT submit AI content without human review
• ✓ Use AI suggestions as coaching, not gospel truth

NYC Local Law 144 Compliance

If you are a New York City resident, Resume Boost is NOT an Automated Employment Decision Tool (AEDT) as defined by NYC Local Law 144.

• We are a coaching tool for job seekers, not a screening tool for employers
• We do NOT make or substantially assist in employment decisions
• Employers may NOT use Resume Boost to screen or evaluate candidates

8. Subscription Terms & Pricing

Subscription Tiers

Cancellation and Refunds

Free accounts have no subscription charge. Pro subscriptions renew according to the billing option selected at checkout until canceled. Cancellation stops future renewals.

• Cancel before your next renewal to avoid the next subscription charge
• Charges for the current billing period are generally not refunded after cancellation
• Billing errors and any rights provided by applicable law remain subject to review

Contact for Issues: If you experience technical problems preventing service use, email support@resumebs.com within 7 days.

9. Job-Search Outcomes

Resume Boost provides estimates and suggestions for job seekers. Employers use different hiring systems and criteria. A score or recommendation does not promise an interview, offer, or employment.

Review every suggested change for accuracy before using it in an application. Changes to these Terms do not waive rights or claims under an earlier offer you accepted. For a prior offer, contact support@resumebs.com with your purchase details so we can review it under the terms that applied when you subscribed.

10. Termination

Termination by You

You may terminate your account at any time:

• How: Use "Delete Account" button in Settings or email support@resumebs.com
• Effect: Immediate account closure, data deletion within 30 days
• Pro Tier: Cancellation stops future billing (no refunds for current period)

Termination by Resume Boost

We may suspend or terminate your account if:

• You violate these Terms (see Section 5 - Acceptable Use Policy)
• You engage in fraudulent, illegal, or abusive activity
• Your account is inactive for 3+ years (see Privacy Policy Section 7)
• We discontinue Resume Boost service (30 days notice)

Effect of Termination:

• Loss of access to your account and all data
• Deletion of your content (resume, applications, AI chat history)
• Forfeiture of any prepaid Pro tier subscription (no refunds for violations)

11. Limitation of Liability

WE DO NOT WARRANT THAT:

• Resume Boost will be error-free, uninterrupted, or secure
• AI-generated content will be accurate, complete, or helpful
• Your resume will pass ATS systems or get you interviews
• Third-party AI services (Anthropic, OpenAI, Google, Perplexity) will be available

TOTAL LIABILITY CAP: Our total liability to you for all claims shall not exceed the greater of: (a) $100, or (b) amounts paid by you to Resume Boost in the 12 months before the claim.

Some jurisdictions do not allow certain liability exclusions. If these laws apply to you, some or all of the above disclaimers may not apply.

12. Indemnification

You agree to indemnify, defend, and hold harmless Resume Boost, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use or misuse of Resume Boost
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Content you upload, submit, or generate (resume, cover letters, etc.)
• Fraudulent job applications or misrepresentation to employers
• Claims by employers or third parties related to your use of AI-generated content

We reserve the right to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate with our defense.

13. Dispute Resolution & Arbitration

Court Carve-Outs (NOT Subject to Arbitration)

The following disputes may be brought in court:

1. Intellectual Property Disputes: Copyright, trademark, patent, trade secret claims
2. Fraud or Abuse: Fraudulent conduct, account abuse, Terms violations
3. Misuse of AI Outputs: Improper use of AI-generated content causing harm
4. Scraping or Reverse Engineering: Unauthorized data extraction, prompt theft
5. Injunctive Relief: Emergency requests for restraining orders or injunctions

Arbitration for Consumer Disputes

For all other disputes (pricing, service quality, billing, account access, etc.), you and Resume Boost agree to resolve claims through binding arbitration:

Small Claims Court Exception

Either party may bring claims in small claims court if they qualify (typically under $10,000 and meet jurisdictional requirements).

Opt-Out of Arbitration

You have 30 days from account creation to opt out of arbitration:

• Send written notice to: support@resumebs.com
• Subject line: "Arbitration Opt-Out"
• Include: Name, email, account creation date, statement: "I opt out of arbitration"
• If you opt out, disputes will be resolved in Delaware state or federal courts

Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

14. Chrome Extension Specific Terms

Permissions & Data Collection

Our Chrome extension requests minimal permissions:

• activeTab: Read current tab when you click extension
• storage: Save your preferences locally
• declarativeNetRequest: Job board URL pattern matching

We do NOT request "all sites" permission. We only access job boards and LinkedIn when you explicitly click the extension icon.

Chrome Web Store Compliance

Our extension complies with:

• Chrome Web Store Developer Program Policies
• Single Purpose Policy (job application assistance)
• Minimal Permissions Principle
• User Data Privacy (see Privacy Policy)

Auto-Fill Disclaimer

Our auto-fill feature is provided for convenience. You are responsible for reviewing all auto-filled data before submission. We are not liable for:

• Incorrect or incomplete auto-fill data
• ATS compatibility issues
• Rejected applications due to auto-fill errors
